Legal Question in Family Law in Massachusetts

shared custody

I have shared legal custody. Unable to contact the father regarding where our son will be living and going to school in 2 weeks. Last I spoke with his father I wanted to leave him in Ohio with his aunt to start and complete the school year, so both of us could get things established. His father said no but hasn't answered my call about the situation. What can I do? Time is limited because he needs to start school. I choose to let him stay in Ohio.

The father is required to let you know. If he refuses, this is grounds for a contempt action.

If I misunderstood your question, let me know.

Re: shared custody

Mr. Lebensbaum is correct, but if you have not moved to Ohio with the Courts permission or your ex-husband's permission, you need to file a motion to permanently move the child out of state. I suggest you do this ASAP.
