Legal Question in Civil Litigation in Massachusetts

I was wrongfully accused of shoplifting and, what is worse yet is that the store owner involved my two young children in the accusation. As a result, there is a "no trespass" order placed against me and my children. I tried to verbally resolve the matter, but neither the owner or the two officers would allow me to speak, other than to state my name and DOB for the order. What can I do to resolve this matter and clear my name? All this was done in front of the other customers and feel my testimony as a Christian is ruined. In addition to that, my children are traumatized now. My Youngest, who is just 5 years old tried to plead with the officer, who ignored him and proceeded to escort us out.

Although I don't know the whole story, it doesn't seem to me that you have a lot of good options here. I don't know what store you were in, but generally speaking the store owner does not have an obligation to let you shop there, and that person is within his/her rights to exclude you. The purpose of the "no trespass" order was to put you on formal notice to that effect. From the sound of it, the store owner doesn't even want to discuss this with you, so my guess is that you would not be very successful in trying to talk him or her into removing the "no trespass" order (although that is a potential option). Without knowing the whole story, my suggestion is to simply move on with your life, and do your shopping elsewhere.
