h-2b to f-1/status until changed

Hi,

entered usa on H-2b visa in dec-2003, working for a resort company as a cook,visa expires on oct-2006 and i finish my job on 10th sept-2006,I wish to change my status to F-1 visa.

If i apply for change of status after my job finishes and the college starts in Jan-2007,can i stay legally until that time in the usa or I need to leave the country...?

If i apply before sept,do i need to stop working for the current employer the same day i file or what...?

You need to file the change of status request before your H2B expires. You can stay in the US while the application is pending. And you don't have to stop working for the current employer if the application is filed with CIS.
