Legal Question in Insurance Law in Massachusetts

Military Death Benefits and Children as beneficeries

If a court order was modified at the time a person enters the military and that person requests that his children will be beneficieries of all death benefits and insurance policies, will his current wife be able to override that request? They were married 4 months after this court order was modified.

Re: Military Death Benefits and Children as beneficeries

Your military death benefits are payable in accordance with your SGLI designation and form DD93. Military regulations may impact the disinheritance of a spuse through these benefits, you will need to talk to your local staff judge advocate (JAG) to be sure. Unless the military is on notice of the court order (a copy should be made a part of your records and also filed with DFAS), they will apply their own rules. Talk to your JAG office.
