Legal Question in Landlord & Tenant Law in Massachusetts

Im curently renting an apartment and as of today 6/21/2011, I owe $300 for the month of May and $700 for the month of June and I just received a certified letter saying I have 14 days to pay or get out, and she is also saying I now owe her $250 in late fees. What are my rights as a tenant, and can she change my locks on my door? I have children. And she also has my security deposit of $500.

I'm sorry to hear this is happening.

First, only a court can evict you. Your landlord has the power to lawfully terminate your tenancy under certain circumstances, but only a court can remove you from the property.

Second, you have the right to pay all rent currently due and avoid an eviction. I would want to know more about these late fees before paying them - are these fees mentioned in your lease agreement?

Lastly, you may simply want to retain counsel to protect the rights of you and your children in a situation like this. Feel free to give our office a call at 617-357-4898 if you would like to talk.
