The landlord is not required to rent the first floor to you.

If you are not happy with your third floor apartment, you should take the first steps in terminating your tenancy (whether under the terms of your lease or otherwise).

If the landlord knows that you are leaving anyway, he might be inclined to allow you to rent the first floor rather than lose you altogether.

There are no facts in your post which would provide a basis for alleging illegal discrimination in housing on the basis of race.
