Legal Question in Landlord & Tenant Law in Massachusetts

Tenant having friends sleepover

Me and my roommate have lived in our apartment for 6 months now, as month to month tenants. Before we moved in, I had asked the landlord if we were allowed to have friends sleepover, and he said yes, as long as they are not living there. There is also nothing in the agreement that we signed that says 'no overnight guests'.

Well, the we've had a friend come sleep over almost every thursday night for the past month and a half (3 or 4 times a month), and now our landlord said that she is not allowed to sleep over, because 'this is not a hotel' and he does not want someone else in his place (even though he does not live in the apartment we rent). He has also threatened to call the police to 'escort her out'. Does he have a right to do this? How often are we allowed to have people sleep over?

I agree with attorney Lee. There is not doubt that the landlord has no right to prevent friends or relatives from visiting your rented apartment.

Assuming visits do not last for an extended period, your guests are not disturbing other tenants or engaging in illegal acts, it is none of his business.

You may want to speak with an attorney if this landlord attempts to threaten or evict you.

Re: Tenant having friends sleepover

Your landlord has no right to declare that you cannot have a regular one-night weekly guest. There is nothing specific in the law about guests, and your landlord needs to chill out. Your separate apartment is yours, so long as you do not bring in a de facto third room-mate full-time.

So long as your regular guest is not causing a disturbance, your landlord is entirely in the wrong.
