Legal Question in Landlord & Tenant Law in Massachusetts

At will Tenancy

I was in a lease which required both the heating oil and propane to be filled upon leaving of the property. That lease ran out last July and I was living at the property at-will since now. Does the gas still need to be filled?Nothing was signed after the lease ran out.

Re: At will Tenancy

I'm going on a dated law school memory, but am pretty sure that when 'at will' terms have not been discussed after expiration of a preexisting lease, the terms of the preexisting lease continue to govern the 'at will' tenancy, except that you are probably free to terminate the 'at will' tenancy upon 30 days notice (or the number of days that pass between your regular rent payment intervals; e.g., 7 days if you pay rent weekly, 30 days if you pay rent monthly, etc)
