Legal Question in Personal Injury in Massachusetts

Legal liability of minors

My son was the driver in an automobile accident. He is now being sued for 600K+ in damages. He was 17 at the time. He was not driving his car or my car. (it was another persons car, and they are also named in this suit. Only he and the owner of the car he was driving are named in this suit. The question is, am I in any way financially responsible for this suit should the plaitiff be sucessful in his suit?

Re: Legal liability of minors

From the facts stated it does not apear that you are liable. YOu have nt been named so any judgment in the case cannot be against you. You should talk with your car insurer in the event you son was drivig without owner's permission to see if you are covered in that event

Re: Legal liability of minors

Hello. The short answer to your question is (and we attorneys love this answer) "it depends".

Have you received any notification that the other party is trying to collect money from you? Has your insurance company contacted you? I do not believe that you need to worry at this time as it is doubtful that you will be named as a party to any action involving your son. It is likely that your son is being named because he is the driver and all parties to the action are typically named. But since it is doubtful that your son has that kind of money, the party suing will likely be more interested in going after the "deep pocket" which is the insurance company of the car involved. I hope I have been of some assistance. - Jim Cook
