Hello,

Your question does not say if you are looking for coverage for the passenger, driver or a defense of the driver or owner.

Usually the frist, primary coverage is on the vehicle, any policies covering the driver personally would be secondary. The coverage on the tow truck is likely to be a business owner's policy with relatively high limits.

The way claims are asserted is, the person making the claim (or often their lawyer) sends a claim letter out to the driver & owner asking that they turn it over to their carriers. Then usually there is a period of producing evidence of liability and damages. Once the sides have a clear picture of what happened, everyone is in a position to make a reasoned judgment about the value of the case. (Attorney accustomed to negotiatons with insurers are especially helpful here).

If you are the owner or driver, notify the carrier right away and cooperate with them.

All legal claims have time limits, I can't say in a forum like this what limits apply to you.
