Legal Question in Personal Injury in Massachusetts

Slip and Fall

My wife slipped on some ice at the Lahey Clinic and broke her arm at the elbow. The hospital had plowed the parking lot but not adequately. It was completly covered in ice. She has not been able to work her part time job as a waitress and has been in some pain.

Do we have a case in order to get lost wages and pain/suffering.

You should contact a lawyer without delay. It is already late since the whole question will be the condition on the day she fell.

Fall down cases are harder to win than most people who bring these claims believe. It has to be more the fault of the one who was responsible to clean the snow and ice than the one who fell. The condition must be an unnatural accumulation and it must have endured for an unreasonable length of time. If they can show they made reasonable efforts to keep it reasonably clear the plaintiff's case is tougher. If the snow fell just before the person, winning at trial can be difficult.

Have your wife act now, time is her enemy.
