Legal Question in Product Liability in Massachusetts

Switched 4 wheeler

Hi. About a year ago I decided to buy a 4 wheeler. I decuded to pay the plan they had of $100 a month for 3 years. As part of the extended warrenty the bike needed to go into the shop for a tune up. When the bike came out of the shop I believe it was not my orrigonal bike. About 7 months has gone by and I just recently decided top check the serial number on the bike and on the bill of sale. The serial numbers do not match. Also when i bought the bike they gave me two keys. When the bike went into the shop I gave them one of the bikes keys. When they gave me the bike back the key that was with the bike worked but the spare key I had did not. The vin numbers on the to keys did not match. Is there anything I can do leagally here?

Yes. If there was a substitution this would violate the MA Consumer Protection Act, Chapter 93A. If you are successful you are entitled to the value of the bike and your attorney fees. The court may also double or triple the amount of your damages.
