If my brother and I bought my parents house for $! in 80's, do I buy him out at current appraisal or appraisal of property then?

Thank you for your question.

If you are interested in buying him out, then you may do so on whatever terms are agreeable to you and your brother. In my opinion, you would purchase the property from him at its current fair market value. The reason for this is because that is how much you would get if you were to put the property on the market today.

If your brother will not cooperate with you, you have the right to force the sale of the property by filing a partition action in the Land Court or Probate Court.
