Legal Question in Real Estate Law in Massachusetts

How do I create a new Deed?

I've been trying to research information on what would be the best way to go about changing the deed to our house.

It is currently in my husbands name, and we want to add mine. We like the idea of the home being protected from creditors (which is why we think Tenancy by the entirety would be the best way to prepare the deed). If an ownership is Tenancy by the entirety, would a living trust be a valid document to ensure that the property is divided between our children upon our death?

We don't have the funds to obtain an attorney, and I'm not sure what type of deed to purchase that would be valid in Massachusetts.

We want to do this as quickly as possible.

I would appreciate any advice you can offer.

A Deed may or may not accomplish what you are trying to do. A Deed that is prepared wrong can create thousands of dollars in problems for later on, and could result in you losing your house to creditors, should they come after your house, and the deed is not prepared correctly.

An attorney can review what you are trying to do, and prepare the correct strategy for you. Can you really afford to risk your house, because you cannot afford an attorney (a few hundred dollars, max).
