Legal Question in Real Estate Law in Massachusetts

estate settlement

My Mom aquired my Dad's business when he passed. She continued to receive $500.00 weekly after taxes. She passed Dec 2006, her estate is in probate. Should she still be aquiring weekly payment towards her estate until her estate is settled?

Re: estate settlement

If the payment was salary, then no her estate should not be receiving a payment. If it was effectively a dividend or a payment not related to services (e.g. Officer or directors fee being a payment for services), then the business could continue to make payments.

Re: estate settlement

I agree with Jonathan.

You failed to describe the nature of the payment and its reason. Your statement conflicts with the word acquired. You need to clarify.

It could be that if it is an earning, this could pass to the beneficiaries.
