Purchasing a driveway

I live in a ''triple decker'' condo on the 1st floor. The person that owns the 3rd floor was the first to move in and therefore had the option to buy the driveway, which he did. He is now moving, Im not sure if it is by choice or if he is being foreclosed on but my question is how can I legally get this driveway from him before he leaves.

You should determine the fair market value of the rights to the driveway, and make an offer to purchase. If he is not interested in selling to you, perhaps the new owner will.
