Do I need to creat an estate?

My younger brother died about a month ago, he had no will, and left nothing. My sister and I paid the cost of his funeral. While going through his wallet I found that he had a retirememt fund. It only amounts to lest that $1800 and the company sent me a check that said ''pay to the estate of (my brothers name) He has no estate, I have not hired a lawyer. My sister and I could use the money to ofset part of the cost of his funeral. How do I go about cashing that check? Do I, can I, create and estate? Any help would be good.

You should create a small estate. Go to the probate court for the county he died in, ask for the form for a small estate administration. It's simple, cheap and quick. Fill out the forms, file them with the court. Take the money.
