can a Massachusetts Judge allow the defendant to spend an inheritance before it goes to trial when a will is being contested

A Massachusetts judge probably could allow a defendant to spend an inheritance. So long as the inheritence in question is in the form of cash or assets, a judge may rule that there is no risk of irreparable harm because cash is fungible. That being said, the executor may have some liability for disbursing funds from the estate while they are in dispute. I strongly suggest that you retain an attorney, as these matters can be quite confusing.
