Legal Question in Wills and Trusts in Massachusetts

Probating Estate With Difficult Heir

I am the designated Executor of a said estate and have not been Court appointed as yet. A said heir to the estate is willfully and knowingly committing identity fraud (assuming the identity of the deceased). Said heir is also dissolving property of the estate (removing and throwing items away) without any authority to do so. Same heir is squatting in deceases house and collecting rent from a recently acquired squatting roommate. While these people squat in this dwelling, utility and other bills have accrued. My question is this: how do I go about recovering money and other property stolen via identity fraud and how can I remove said heir off the property and have the estate reimburse for the payments of accumulated bills?

Re: Probating Estate With Difficult Heir

You need to get appointed as executor by the Court as soon as possible. This will enable you to take certain actions to secure the property. You, however, may not be able to simply change the locks because a tenancy may have been established by one or more of the squatters. Please contact me at my office number to discuss further. I have other cases similar to this and may be able to provide you further assistance.
