Legal Question in Bankruptcy in Michigan

chapter 13 discharge

we are 3 years into our chap.13. we have 10 months to go. we are having trouble making the payments for the first time since we started, and would like to know if we can have it discharged because its been 3 years. or can we use out tax return to catch up on our bankruptcy payments. alo i heard after 3 years you can roll it into a refinance on your house, is that true? we are thinking about chapter 7 but we are afraid of what it will do to our credit scores. thank you for your time.

You ask many questions - many of which your attorney should be able to answer by looking at your case history on the trustee's system. Is he or she not returning your messages? You have a few options depending on what your pay history is and how your creditors have been paid. You could dismiss and handle your creditors outside of the bankruptcy, refinance through a mortgage company if you have a good payment history or move for a hardship discharge.
