Filing without spouses knowledge

Can I file Chapter 7 in my own name without my spouses knowledge? All debts named in the bankruptcy would be accounts opened in my name only. I don't want my husband to know about it.

Yes, you can file without your husband finding out so long as he is not a co-debtor on a house or other debt for which are joint account holders. You must list all of your debts (including debts on houses and cars), regardless of whether or not you intend to repay the loan in full.

If these are your debts and you are over 18, you should feel comfortable about making decisions that are best for you and not have to worry about what your husband thinks unless you are worried about domestic violence.

Yes you can. However, you need to asses whether this is in the best interest of you and your family. I highly doubt that you will be able to keep this a secret from your husband. Has anyone actually determined if this is the best course of action for you? Find a qualified attorney.
