Legal Question in Bankruptcy in Michigan

Reaffirmation

I recently filed for Chapter 7 Bankruptcy using a computer program I purchased to make the paperwork for me without the help of an attorney as I could not afford one. I have already been to the meeting of creditors, and when I was there only one attorney showed up. They represented my auto finance company, and at thie meeting I signed papers reaffirming my debt even though my monthly expenses vastly outweigh my monthly income. At the time I thought this was the only way I could keep my car. Now I have been sent another letter from the representatives of my home finance company. Do I have to reaffirm these debts to keep the possessions? And if not is there a way to get out of the papers I signed earlier for my car. I can't see how filing bankruptcy will help me if this is the case as these debts make up almost half of my monthly debts and three-quarters of my total debt.

Re: Reaffirmation

Read your reaffirmation agreement on your car. It will say that you have a certain amount of time to back out of it. Let the car go and get a cheaper one - you'll get dozens of offers from local dealerships to finance a new or used car after your discharge.

With regard to your furniture, it's been my experience that if you refuse to reaffirm that they will drop it. Of course, this is assuming that your petition reflects that the debt to the furniture company is unsecured debt. If not, well, you can amend your petition with the help of an attorney.
