Legal Question in Bankruptcy in Michigan

Responsibility of separate debts

I'm considering filing Chapter 7. The only reason I'm ''considering'' rather than ''doing'' is this:

I've created this financial nightmare; I've done all of this behind my husband's back; he had absolutely no idea of how bad off I'd gotten until I broke down with guilt and confessed. Will my filing for just my debts ruin his credit, which has been spotless until this? Will he be responsible for paying off my debts rather than my filing bankruptcy? I must also tell you that we've been separated since March 1998, off and on, but not legally. If you need more information I'll gladly give it to you.

Thank you,

Karen

Re: Responsibility of separate debts

Greetings; If you file individually, your filing will not affect his credit. However, if you ever file for a joint loan, your record will limit your joint loan ability. If the loans are in your name, he will not be responsible for paying them. If they are joint, he WILL be responsible. I suggest you make an appointment to discuss your situation in detail.
