Legal Question in Civil Rights Law in Michigan

Should minors be allowed to sue an adult without a parent or gaurdions permisoin

I am a 12 year old and I think minors should be allowed to sue an adult withot a gaurdians permisson.Minor should be allowed to sue for things such as money, damage, abuse, and other importand issues.I also think i this case that a parent wouldn't allow the child to sue them or anyone else they feel, isn't nessasary. To some childen, some issues are more important than they think to them. For example smoking around a child may make them feel uncomfortable but the parent will not allow debate or disccusion with them.If it gets exstreme, I believe they should be allowed to sue there gaurdian.A parent does have the right to make a childs choises BUT the child should be allowed to sue them in extreme cases. In conclusion,I believe this should be taken in to consideration.Thank you for taking the time into reading my letter. I hope this maybe consider.

Yes, parents DO get to make decisions for their children. In fact, they are REQUIRED to do so. You may not like their decisions, but unless they are harming you, you're going to have to live with it for about 6 more years.

If they are harming you, then you have the right to ask a court to intercede, which is similar to a lawsuit, but what happens is that a judge makes decisions and gets in between you and your parents. It means that instead of someone who knows you (and probably loves you), you'll have some grumpy old guy who doesn't know you and probably doesn't really care.

Smoking IS harmful, but it's not the sort of thing a judge should be involved with. Living with bad things (unless they're really abusing you in some way), like smoking or serving fast food all the time, is part of family life.

If you don't like your parents smoking, make you can negotiate that they don't do it in your room, but remember it's their house, their rules.

You can also do things like make sure you take your vitamins and do your best to be as healthy as possible.

HOWEVER, if you ARE being harmed, then you should report the abuse. Please don't take my comments as telling that your parents have the RIGHT to abuse you, only that it has to be real abuse, not simply smoking when you don't like it.
