Legal Question in Consumer Law in Michigan

Gardner white insurance-credit life insurance scam ?

I purchased gardner white furniture in 2005 and I signed I did not want the insurance that was optional. he had me sign in two places and I told the sales manager I do not want the insurance and he crossed the ''no, I do not want the credit life insurance'' part out. I never got a bill a bill from the credit life insurance until 2 yrs after I bought the furn, $279.00. I called and complained and explained what happened,,,,so they told me they would refund the total amount. I did get a refund of $25.00 dollars instead of the entire amount. I am taking them to small claims court because nobody is helping me out with this dilemma. When I do call and try to resolve this issue, the furniture place says they cant help me, the credit life insurance company cant help me after repeatedley calling them. I was told I cant sue for Fraud. what other words can I use that would be acceptable instead of using the word ''fraud''. Any other advice/suggestions would be very helpful. Thank you in advance for your time.

Re: Gardner white insurance-credit life insurance scam ?

Its very simple - Breach of contract. You didnt want the credit life, checked the box no, and they charged you for it anyway. It also violates the Michigan Consumer Protection Act, but thats another story. Contact me at www.kliszlaw.com to discuss further. Tim Klisz
