Legal Question in Credit and Debt Law in Michigan

Debt collection- joint checking account

Can a bank freeze funds in a joint checking account, after an account holder dies, to collect on a bank loan? The loan only has the deceased account holder's name on it.

Re: Debt collection- joint checking account

Yes- If you let them- hire a lawyer. We have handled similar cases to a successful resolution.

Some information that is missing from your hypothetical: when did the deceased die? was an estate opened? was notice given to creditors at that time? Is the joint account holder a creditor? were there other obligations of the deceased? was it the joint account holder's money?
