unpaid loan

I used a payday advance service and the check I wrote to them did not go through my bank due to nsf charges. I have not been able to pay this check yet and I am supposed to appear in small claims court. I cant make my court date because my grandma has to have surgery and I will be out of town. Can you go to jail for an unpaid bounced check?

While bounced checks might fall into the criminal fraud arena depending on the situation, usually it is a matter of civil liability (and the penalties can be severe). You generally have thirty days to make good on the bounced check and related costs to avoid liability on the instrument and further penalties. As an aside, if you fail to show up at the small claims hearing, a default may be entered against you. www.lawgreg.com
