Wage Garnishment

is it legal to garnish someones wages without even notifing them? the debt is 13 years old. and my checks are being garnished and i was never notified. one day the money was gone from my check without my permission or notification.how can i find out if there was a court order?shouldnt i have had the right to at least pay the debt or to make payment arrangments.

There are several defenses to garnishment. A garnishment required a court order, so you must go into the court that issued the garnishment and fight it there.

The garnishee (your employer) is responsible for notifying you of the garnishment. You are responsible for objecting to the garnishment in court, and a court-approved payment plan would halt the garnishment.
