Legal Question in Credit and Debt Law in Michigan

My wife just passed away. A credit card (account) is in her name only. Am I responsible for the card payment? We have a living trust, can the creditors come after the trust or the estate? Is it Michigan law that I am not responsible for the payment?

As long as the credit card is not in the name of the trust (I doubt it) you are clear. Her estate owes the debt and would have to pay it from any estate assets. There are no estate assets, so no money to pay debt. Simple probate law at work. Visit kliszlaw.com to discuss further. Tim Klisz
