Legal Question in Criminal Law in Michigan

Assaulted

This past weekend my little brother was assaulted from behind. He didn't fight with the guy he just drove to my house and we called the police. The person who hit my brother was not taken to jail. We called the D.A. and was told they would start to work on the case next week sometime. Is there a need for me to hire a lawyer?

Assault is a finding of law made by a prosecutor based upon the facts stated by your brother before any warrant can be issued.

The process has nothing to do with you unless you're his guardian.

There are no facts in your post from which an attorney can make any conclusion.

If no warrant is issued, there is no practical need for an attorney. If a warrant issues and a conviction results, your brother may interest an attorney in taking a civil case.

This appears unlikely since your post fails to mention any compensable injury or possibility of collection if your brother prevails in court.
