can you be charged with license suspended if you are not in possession of the key as well as not in the car and the car is parked and never pulled over

Being charged with one thing, having your guilt proven beyond all reasonable doubt is another matter entirely. They will have to prove by direct or circumstantial evidence that you were driving your car while your license was suspended. if charged, contact a Michigan criminal defense attorney at once with experience in defending driving while license suspended (dwls) cases.

If a witness saw you operating a motor vehicle, and that witness is believed by the judge or jury, then you could be proven guilty. The prosecutor must prove beyond a reasonable doubt that you had operated a motor vehicle on a public road when your license was suspended. The fact that you did not have possession of a key or that police had contact with you after the fact and did not personally witness the operation are points in your favor, but they are not necessarily fatal points for the prosecution's case.
