my brother was forced to take plea agreement without the dna test results can he refused the plea before his sentencing date if he files this motion how long will it take

There is no right to withdraw a plea. The judge MIGHT allow your brother to withdraw his plea. He is facing a very long prison term and he should not have pled guilty if he is not guilty. If he wants to hire a lawyer to help him, you can read more at:

No one is forced to take a plea. A judge specifically asks if the person is being threatened or coerced into taking a plea. That being said, he can always withdraw his plea prior to sentencing. That is black letter law. Visit www.kliszlaw.com to discuss. Tim Klisz
