Re: Marijuana

Possession of Marijuana --- MCL 333.7403(2)(d); MSA 14.15(7403)(2)(d) --- is a misdemeanor.

The prosecutor must prove that you knowingly or intentionally possess the controlled substance marijuana.

If convicted, you face up to 1 Year in jail and/or up to a $2,000.00 fine + court costs. You can be put on probation for up to 2 years. The court will also inform the Secretary of State of the conviction, and your driver's license will be suspended for 6 months with no driving for the first month, and a possible restricted license for the last 5 months (if you apply for it and show proper need).

This all assumes that you haven't been convicted of a drug crime before. If you have priors, the penalties may be higher.

You might be eligible for a "probation + dismissal" type program under MCL 333.7411 (we call it "7411 status"). Talk to a lawyer who handles criminal cases, especially drug crimes, to see if you are eligible and/or what you have to do to enhance your chance to get this one-time deal.
