Legal Question in Criminal Law in Michigan

If given a restricted license, will it apply to my CDL?

My license has been suspended for 6 months. I can request a restricted license after 30 days. I drive a truck for a living and need my CDL to drive. Can the judge reinstate my CDL as part of the restriced license? I am unable to work until I have the CDL.

I was charged with delivery of marijuana, but my vehicle and driving was not involved. It was my first offense of any kind and I have a clean driving record. I have passed my first drug test, and will pass all future ones, and have already made arrangements to start my community service.

Any insight would be greatly appreciated.

If this was your first drug-related offense, your plea of guilty could have been taken under advisement. The statute that allows that is MCL333.7411. Under that statute, no license restrictions apply. Did you have an attorney? It really sounds as though you did not. You may want to consider hiring an attorney to withdraw your guilty plea and then proceed under this statute. If you want to discuss further, feel free to call my office at no charge to you.
