If the only evidence they have against you is the officer testimony should you go to trial on a first offense. No breath test or blood test. Warrant denied by county prosector for blood test.

It would depend on the circumstances.

However, if things are as you say, I believe they would have a pretty uphill battle proving your impairment.

You will need to have someone who is experienced in these issues and knows how to cross-examine a police officer.

Also, depending on the circumstances, you may be able to challenge the pretext of your being stopped.....which could have the effect of tossing the entire stop.

It depends on the circumstances. What I would normally do is negotiate a substantially lower charge that will end up costing you less in time and money.
