Legal Question in DUI Law in Michigan

getting pulled over by state police

I was a passenger in my auto with an open intox Sat. at 12:30am. My driver does not recall why we were pulled over. I have called the state police and left 2 voice messages regarding this incident. I have received no response. The Trooper repeatedly asked me if I have left a beer tent at a local festival with the intox. I said, I might have, I think I did. They were at the beer tent and I spoke to them because I was organizing the parade for the following day. I suspect they followed me out, thought that I was driving, pulled us over and got me with an open intox instead of a Drunk driving. Do they have to tell you why they pull you over and why won't the Trooper call me back? I know he works Midnight shifts....Is there any cause for me to get an attorney to avoid a misdemeanor or not? Thanks Kat

Re: getting pulled over by state police

Why would the Trooper call you back? They have done their job and arrested you. It now goes on to Court and you will deal with the County Prosecutor. The open intox is much less severe a crime than OWI, and if you have no priors, they might let you take it under advisement.
