Legal Question in DUI Law in Michigan

Surpressing blood Alcholo test results

I'm a diabetic experiencing abnormally high sugar (glucose) levels, at the time of testing. I also suffer from Multiple Sclerosis. Both diseases affect how my body metabolizes and processes alcohol. Has there ever been a successfully mounted legal agrument, questioning the admissability of the blood alcohol testing results, when ailments like/ or similiar to mine were present.

Hello, I have received your posting regarding breath-alcohol tests for a person with MS or having high glucose levels. There is NO case in Michigan that is on point. The current political climate of the Courts in this state would make such an argument an uphill battle. However, it does make some sense from a scientific point of view. You have the type of case that could make new law. It also makes a difference what court you are in, what city you were arrested in, and which prosecuting agency (city or county) is involved.
