Legal Question in Family Law in Michigan

adult child financial obligation

I was separated in December 2003. In the separation decree, my husband (and myself) are each required to pay $24,000 or $500 a month for 48 months toward my daughter's college education. He also decided for the past six months to voluntarily pay $700 instead of $500 because it was no longer covering 1/2 her college bills.

My husband is now saying (after a falling out with his daughter) that he has paid more than his share ($24,000) if you include medical, summer internship, and other monitary gifts. Is he still required to continue to pay $500 toward her tuition as stated in the separation decree?

The court order should be reviewed by your lawyer to check the exact wording. The wording may determine the answer to your question. In addition, each judge might have a different opinion of the wording. Your best bet is to begin with your lawyer since there is not a clear cut answer to your question.
