i do not have a child support order as of yet. is it legal for me to move out of state with her? her father and i never married. but he did sign a perternity affidavid.

If there is no court order preventing your from moving, you are free to do so. I would STRONGLY recommend that you meet with an experienced family law lawyer before doing anything. The court might require you to bring the child back.
