Legal Question in Family Law in Michigan

divorce prperty settlement

My husband and I are about to file for divorce and have already agreed on the settlement of poperty. He has agreed to give me his annuity fund and one of our two homes. Both homes are in his name and have mortgages. Can he just sign a quick claim deed to me? I am a homemaker therefore have no proof of income for financing. What do we have to fill out to award the annuity fund to me?

It sounds like you might be making the horrible mistake of not being represented by an attorney. Don't settle anything without an experienced attorney to guide you through. You're likely to make critical mistakes that could cost you a lot.

How are the mortgages going to be paid for? I do not think there is an easy way to deal with this settlement. I agree with Mr. Kronzek you should consult a family law attorney to make sure this agreement is fair and that any property transfers are done properly. I also think these mortages need to be dealt with appropriately as well. You do not want a situation where you own the house, but the mortgage isn't getting paid so you lose the house anyway.
