divorce realistate question

Hello,

I understand that within mi. if you own property before your married, that's considered separate property, & the property aquired during marrigage can be considered marital property. My question is this. If I own my home excusively, & were to remarry, then I choose to buy another home, using the money from the sale of the initial home, which I owned exclusively before marriage, how do they look at that new home, If things didn't work out & we divorced. I don't necessarily want a prenupt, but don't want to run out & get into a new house right away for that technicality. Thanks for any help or information. Rob D.

It's not clear cut. If you sell and house and co-mingle the funds with your wife's funds, it would probably be marital property. Even if you keep the house in your name, if you are married a long time, it will be deemed to be marital property. If you're worried bout it, don't get married. William S. Stern

There is no way to assure that your assets will be protected. A prenuptial agreement is your best bet.
