I am a dad divorced two kids. I have joint legal custody. My ex wife is telling me i can not take my kids to a doctor only she can. By right can i take my kids to a doctor of my choice being it is my health insurance they are under?Does she have the right to stop me

If you truly have joint legal custody and the Judgment does not prevent you from taking the children to the doctor you should have the right to take your children to a doctor if necessary. I would suggest having an attorney review the Judgment to be sure.

The way I look at it, joint custody means that the parents consult and agree with each other on important issues, including medical. The parent with the child at a particular time has the right to take the child to a doctor if the child gets sick. For regular checkups, etc., it would seem to be a mutual decision. If you cannot agree on such things, the judge may likely terminate joint custody and award sole custody to one parent. That solves the dispute. William S. Stern
