Legal Question in Family Law in Michigan

Husband's claim on property?

I put down the $20000 some odd money as a down payment on this property. I now have twins and have temporarily given up my employment. My husband has been making the majority of the mortgage payments. The majority of the payments are going to interest. Do I have more interest in this home or my husband? My husband feels he has more ownership because he usually pays the mortage. I think I have I have more ownership because I paid the down payment which went right to the principle. Please tell me who is right!

Re: Husband's claim on property?

Unless the deed to the property or some other agreement between you says otherwise, you own the house equally.

Re: Husband's claim on property?

You're both wrong. With the facts you gave, it would be marital property in the event of a divorce and you would both be entitled to the equity, probably equally. When you co-mingle your assets like that, it becomes marital property. William S. Stern
