Marriage

Please advise me of my rights. MY marriage of 23 years has been verbally abuse and some physical at time. I am tried to make it work it has only gotten out of hand. I have no place to go or really trust any one help. I am unemployed and I received unemployment benefits that will soon end. My husband received a pension check monthly. Please advise me if I am entiled to some of his benefits. He tells me I am not entiled because I didnt work for it. Please advise me of my rights I need to move on with my life. Help!

My response relates to Minnesota divore since your question is unclear as to the state.

First, any analysis of a divorce and the possible reprecussions with respect to spousal support or preoperty division would require a full review of the facts. Youhave provided very little in your post.

However, with respect to property division, as a general rule you have a marital interest in anything that was acquired during the marriage. That would include the value of any retirement assets.

You are probably entitled to half of his pension. In addition, you may be able to have him pay for your attorney in the event you divorce. We have experience in family law and may be able to help you with this if you contact our office
