Second marriage--spousal right to property

DAughter married one year to second husband--- He moved into her home that she is sole owner of. Now there are marital problems--he is violent and abusive and refuses to leave--- he has also trashed the house and put holes in the newly redecorated kitchen. Police were called --told him to leave--he would not--so she has left with four year old daughter.She wants to return to her home but wants him OUT. What are her rights??

The police should have put him out. Now, she needs to file for divorce to avoid further encounters. She should be awarded the house in a divorce. For more info, please contact my office at (248)851-3171.
