Purchase of Second Home

My sister-in-law's husband is going to purchase a second home in Canada, and he said he is going to purchase this home without her signature on the house title. They have been married for ten years and she would like to know if this is legal. Their marriage is on the rocks and he threatens to divorce her daily. Can you advise?

He can purchase the second home without her signature. However, in the US, he would not be able to sell the second home without her signature because she automatically has dower rights (a 1/3 life interest in the real property of the husband) because the husband is married. Also, even though her name is not on the title, it would still be considered marital property in the event of a divorce. so the bottom line is, she has protection. Bill Stern 248-353-9400
