Legal Question in Family Law in Michigan

Help for son

Son lost his job, moved family to another county, wife moved to an apartment since she had a job and now wants a divorce and there are kids involved. Does he need to retain an attorney in the same county wife is in (Oakland)? they both lived in Oakland County prior to move.

Your son can hire an attorney wherever he wishes, as long as the attorney is licensed to practice in Michigan. There is a requirement that the person filing for divorce must have lived in the county where they file for at least 10 days prior to filing. So, if the wife has already filed in Oakland county, your son can hire an attorney anywhere in Michigan. If your son will be the one filing for divorce, he just needs to file in the county where he is now living. It does not matter what county the attorney is in (many attorneys practice in several counties.)

Any lawyer who is licensed in Michigan can practice throughout the state. No lawyer is limited to particular counties. Just get a lawyer who gives a good value and with whom your son has a good relationship. William S. Stern
