Legal Question in Family Law in Michigan

My spouse and I have been divorded since March of 2005. The last two years we have had joint physical custody of our children and have volunteered to be removed from the Friend of the Court. Now, I will be moving the end of the summer for financial and employment reasons and my son, now 16, but will be17 in July, wants to move with me. We are both confident that his mother is going to resisit this move, and want to know what our best recourse on this matter is. The friend of the court in Michigan is not required to honor the choice of a minor, and in Clare county they tend to side with mothers.

File a petition with the Court the FOC has nothing to do with it unless a recommendation is ordered. The judge will just follow the wish of the 17 year old absent some other controlling factor. Call us for a free consultation 877 887 9562
