If marital funds were used to purchase this home, then your portion is considered a marital asset. If it is considered a marital asset, then your portion would likely be subject to division in the event of a divorce. That being said, the topics of division of property and marital assets are not simple and they are very fact specific. You should consult with a family law attorney to review the facts of surrounding your case. Good luck.

Use of marital funds to buy your half of the home is one of the ways that you husband might own half of your 1/2 of the home. There are other ways as well. Meet with an experienced family law attorney to discuss.
