Wife left with Children and receives an Adoption Subsidy

My wife left and took our two children with her. She receives an Adoption Subsidy of $1,500 per month for both girls.

If I file for a Legal Seperation will the court consider the Adoption Subsidy as Income for my wife in calculating Child Support/Alimony?

Can I legally force her to return the children home?

In my experience, courts treat the adoption subsidy as income that will lower your child support obligation. You can probably get a court order preventing the move, unless she has a great reason. William S. Stern
